1. Acceptance of Terms
By accessing or using SBmenu (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.
2. Account Registration
You may register for an account using email with a one-time password (OTP), or through supported third-party sign-in providers including Google and Telegram. You are responsible for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. Notify us immediately at [email protected] if you suspect any unauthorized use of your account.
3. Service Description
SBmenu is a digital menu platform that enables restaurant and cafe owners to create, manage, and publish multilingual digital menus. You can build menus with categories and dishes in Arabic, English, and Kurdish, upload images, generate QR codes for your establishment, and publish your menu at a public web address. Guests access your menu by scanning a QR code or visiting your public link — no app installation is required. You can manage your menu through our web dashboard or directly inside the Telegram app via the Telegram Mini App. SBmenu may add, modify, or remove features at any time without prior notice.
4. Billing and Payments
SBmenu charges a flat fee of $5.00 USD per establishment per 30-day billing cycle. (a) Free Trial. Each new establishment begins with a 7-day free trial. No payment method is required during the trial period. At the end of the trial, you must add a payment method and enable auto-renewal to keep the establishment active and publicly accessible. (b) Auto-Renewal. Billing renews automatically every 30 days for each establishment that has auto-renewal enabled and a saved payment method. You will be charged $5.00 USD per establishment at the start of each billing cycle. You may turn off auto-renewal at any time from your billing settings. When auto-renewal is turned off, your establishment remains active and accessible until the end of the current paid period, after which it will be deactivated. No refunds or credits are issued for partial billing periods. (c) Payment Methods. We accept credit and debit card payments processed through Stripe, a secure third-party payment processor. Your full card details are never stored on our servers — they are sent directly to Stripe. We also support manual (cash) payments as an alternative where offered. All prices are in US Dollars (USD). We reserve the right to change pricing with notice; price changes will not affect billing cycles already paid for.
5. User Content
You retain full ownership of all content you upload or create through the Service, including establishment names and descriptions, category and dish names and descriptions, prices, and images ("User Content"). By submitting User Content, you grant SBmenu a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content solely as necessary to provide the Service to you and your guests (for example, displaying your menu on the public menu page). This license ends when you delete the User Content or your account, except for content shared with others (such as public menu URLs) that may persist in caches or archives. You represent and warrant that you own or have the necessary rights to all User Content you upload, that your User Content does not infringe any third-party intellectual property rights, and that you have obtained any necessary consents for images depicting identifiable individuals.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable laws or regulations; (b) upload, post, or transmit any User Content that is unlawful, defamatory, harassing, threatening, obscene, hateful, or otherwise objectionable; (c) interfere with or disrupt the Service, its servers, or networks; (d) attempt to gain unauthorized access to other user accounts, computer systems, or networks connected to the Service; (e) resell, sublicense, rent, lease, or otherwise commercialize the Service without our express written permission; (f) use the Service to distribute malware, viruses, spam, or other harmful code; (g) scrape, crawl, or systematically extract data from the Service without permission; or (h) impersonate any person or entity or misrepresent your affiliation with any person or entity.
7. Intellectual Property
The SBmenu platform, including its source code, design, user interface, logos, trademarks, and branding ("SBmenu IP"), is owned by SBmenu and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the SBmenu IP without our prior written consent. Your User Content remains your intellectual property. By submitting feedback, suggestions, or ideas about the Service, you grant SBmenu a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without compensation or attribution.
8. Third-Party Services
The Service integrates with third-party services for payment processing, authentication, image hosting, and email delivery. Telegram is a core integration — the Service operates as a Telegram Mini App and supports sign-in via Telegram. We do not control and are not responsible for the availability, accuracy, security, or practices of any third-party services. Your use of any third-party service is subject to that service's respective terms of service and privacy policy. You acknowledge that SBmenu is not a party to any agreement between you and a third-party service provider.
9. Privacy
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, available at /legal/privacy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SBMENU, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF SBMENU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SBMENU'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU HAVE PAID SBMENU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATIONS SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.
12. Termination
You may terminate your account at any time by using the account deletion feature within the Service or by contacting us at [email protected]. Upon termination, your right to access and use the Service ceases immediately, and your public menu pages will become inaccessible. We may suspend or terminate your account and access to the Service, with or without notice, if: (a) you violate these Terms; (b) your use of the Service exposes us to legal risk or regulatory action; (c) your payment is declined or remains unpaid; or (d) you engage in fraudulent, abusive, or illegal activity. Upon termination, we may retain certain information as required by applicable law or for legitimate business purposes, including payment records for financial compliance, in accordance with our Privacy Policy.
13. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SBmenu regarding the Service and supersede all prior agreements, communications, and understandings, whether oral or written. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Changes to These Terms
We may modify these Terms of Service from time to time to reflect changes in the law, our Service, or our business practices. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and, where appropriate, providing notice through the Service or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
