1. Acceptance of Terms
By accessing or using this website and its services, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. You must be at least 18 years old to create an account.
2. Account Registration
You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information when creating your account. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
3. Subscription and Payments
This is a subscription-based service. By subscribing, you agree to pay the fees applicable to your chosen plan. Payments are processed through third-party payment processors. Stripe subscriptions auto-renew each billing period until cancelled; Telegram Stars payments are one-time and do not auto-renew. You may cancel at any time — cancellation takes effect immediately. Refunds are handled in accordance with the applicable payment provider's policies.
4. User Content
You retain ownership of the content you upload, including restaurant information, menu items, descriptions, prices, and images. By uploading content, you grant us a limited license to host, display, and distribute that content solely for the purpose of providing the service (i.e., displaying your menu to customers). You represent that you have the right to upload all content and that it does not infringe any third-party rights.
5. Acceptable Use
You agree not to: use the service for any illegal purpose; upload content that is unlawful, defamatory, harassing, or obscene; interfere with or disrupt the service; attempt to gain unauthorized access to other accounts or systems; resell or sublicense the service without permission; or use the service to distribute malware or spam.
6. Intellectual Property
The platform, including its code, design, logos, and branding, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the service without prior written consent. Your restaurant content remains your intellectual property.
7. Third-Party Services
The service may integrate with or rely on third-party services for payment processing, authentication, hosting, and email delivery. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.
8. Privacy
We collect only the information necessary to provide and operate the service — such as your email address for account access, restaurant and menu details you provide, and images you upload. We do not store or process sensitive personal data.
9. No Warranty
The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or available at all times.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
You may terminate your account at any time by deleting your account. We may suspend or terminate your account if you violate these terms, engage in illegal activity, or if your subscription remains unpaid. Upon termination, your right to use the service ceases immediately.
12. Entire Agreement
These Terms of Service constitute the entire agreement between you and us regarding the use of the service, superseding any prior agreements, communications, or understandings, whether oral or written. No modification of these terms shall be effective unless posted by us as an updated version.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes through the service. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.
